These Terms and Conditions ("Terms") govern the access and use of the website, contact channels, and, where applicable, access to MIGTRA's support and platform functionalities.

By browsing the website, submitting a form, requesting a demo, or using access/support functionalities, you declare that:

  • You have read and accept these Terms.
  • You will use the website and/or services responsibly and in accordance with the law.

If you do not agree, please do not use the website or the services.

3) Definitions (to Avoid Confusion)

  • "Website": public pages of www.migtra.com and its sections (blog, contact, etc.).
  • "Platform" / "Services": MIGTRA's technological solutions (e.g., risk management, productivity, dashboards, maps, and associated functionalities).
  • "Client": company that contracts MIGTRA's services.
  • "User": person who accesses the Website or uses the Platform on their own behalf or on behalf of the Client.

4) Scope: Website vs. Client Contract

These Terms apply to the use of the website and standard interactions (contact, demo, support).

If your company contracts the platform, commercial agreements/contracts typically exist (e.g., proposal, SOW, SLA). In case of conflict, the signed contract between MIGTRA and the client shall prevail.

5) Permitted Use of the Website and Platform

You may use MIGTRA to:

  • Learn about solutions and content.
  • Request contact or a demo.
  • Access support (if applicable) and, if you are an authorized user, operate the platform according to your permissions.

Not permitted. You may not (nor assist others to):

  • Access restricted areas without authorization (e.g., support/user areas).
  • Breach security, interfere with functionality, or conduct penetration testing without authorization.
  • Copy, scrape, or collect data from the website in an automated manner without permission, reverse engineer, decompile, or attempt to extract the platform's code/algorithms.
  • Use the website or platform for illegal activities or activities that affect third-party rights.

6) Accounts, Access, and User Responsibilities

If you have an account (e.g., for support or platform access):

  • You are responsible for maintaining the confidentiality of your credentials.
  • You must notify MIGTRA if you suspect unauthorized use.
  • You agree that MIGTRA may suspend access in the event of security risks or misuse.

7) Information and Data Processed in the Services (Depending on Contract)

MIGTRA operates with data necessary to deliver operational value. Depending on the contracted solution, the platform may process:

  • Data for risk management (e.g., analysis of speeding/fatigue).
  • GPS-based information and dispatch data.
  • Operational dashboards and reports, online maps, and performance analysis.
  • And, if applicable, video analytics for productivity and/or safety in operational zones.

Important (B2B): the client is responsible for obtaining the necessary internal authorizations and legal bases for the processing of data from its employees/operations (e.g., drivers, cameras, GPS, etc.), in accordance with applicable regulations.

8) Privacy and Data Protection

The processing of personal data is governed by MIGTRA's Privacy Policy (published on the website). For the purposes of these Terms:

  • MIGTRA takes reasonable measures to safeguard information.
  • The client/user commits to using the platform in compliance with privacy and the law.

9) Intellectual Property

All content on the website and platform (trademarks, texts, images, software, models, and reports) is the property of MIGTRA or used under license, and is protected by intellectual property laws.

License of use: MIGTRA grants the authorized User a limited, non-exclusive, and revocable license to use the platform solely for the client's internal purposes and in accordance with the contracted service.

10) Availability, Improvements, and Maintenance

MIGTRA strives to maintain operational continuity, but access may be affected by:

  • Scheduled maintenance.
  • Third-party failures (internet, cloud, integrations).
  • Force majeure events.

When possible, we will communicate maintenance and relevant changes in advance.

11) Third-Party Integrations and Services

The platform may integrate with client or third-party services (e.g., operational data sources). MIGTRA does not control such services and is not responsible for their availability or failures, unless expressly agreed in the contract.

12) Pricing, Payments, and Billing (If Applicable)

If paid services are contracted:

  • The price, payment method, term, and scope will be stated in the proposal/contract.
  • Applicable taxes will be those determined by current regulations.
  • Non-payment may result in service suspension, in accordance with the commercial agreement.

13) Informational Content and "No Warranty"

The information on the website (including the blog) is of a general nature. MIGTRA does not guarantee that the content is always complete or up to date, and may modify it at its discretion.

To the extent permitted by law, the Services are provided "as is" and MIGTRA does not guarantee specific results (e.g., exact savings or reduction levels), as they depend on multiple operational variables (specific commitments should be established in the contract/SLA).

14) Limitation of Liability

To the extent permitted by law:

  • MIGTRA shall not be liable for indirect losses (lost profits, loss of opportunity, etc.).
  • Nor for damages arising from third-party failures, misuse, or breach by the client/user.
  • Nor for operational decisions made exclusively by the client based on reports/indicators, without validating actual operating conditions.

15) Suspension and Termination

MIGTRA may suspend or terminate access to the website/platform if:

  • There is misuse or illegal use.
  • Security is compromised.
  • These Terms are violated.
  • For reasons established in the contract (if applicable).

The user may stop using the website at any time. The termination of a contracted service shall be governed by the current contract.

16) Modifications to These Terms

We may update these Terms to reflect operational, legal, or security changes. We will publish the current version on the website indicating its update date.

17) Governing Law and Jurisdiction

These Terms are governed by the laws of Chile, unless a specific contract with the client establishes a different jurisdiction.
